What is Mediation?
Mediation is a process that involves bringing a third person, also known as the mediator, into a dispute to assist both parties in negotiating an acceptable resolution of the issue(s) in conflict.
The mediator will not offer legal advice nor any opinions, but instead, will talk through the issue(s) in conflict, and possible resolutions. The mediator will work with both of the parties until they are able to reach an agreement, or until it is clear that there can be no agreement reached.
If the parties agree on a resolution, the mediator will write a non-binding memorandum of understanding which will be used to draft a stipulation and order for the court. If the parties do not agree on a resolution, the mediator will report this to the court, and the parties may move on to the trial process to reach an agreement.
