Can I Move to Another State With My Child After Divorce?
It depends. In Utah, custodial parents cannot move significant distances with their children after a divorce if they have not obtained the other parent’s permission first. Before moving long-distance with a child after divorce, parents must first:
1. Give the other parents written notice.
If the custodial parent is planning on moving 150 miles away from their current residence, they are typically required to provide written notice to the other parent and the court at least 60 days prior to moving. After receiving notice, the other parent is given 30 days to object to the relocation.
2. Attend the scheduled court hearing.
The court will consider may factors to determine whether or not the relocation is in the child’s best interest. Reasons may include:
- The relationship with the child and both parents.
- The reasons and motives for the relocation.
- The potential impact on the children.
