What is a Prenuptial Agreement?

A prenuptial agreement (prenup) is a written contract created by two people in anticipation of a marriage. Prenuptial agreements are enforceable in Utah. Common items included in prenups include:

 

  • The rights of each party regarding managing, buying, selling, and leasing property.
  • The modification or elimination of alimony.
  • Ownership rights. 
  • Protections against the other’s debts. 
  • Descriptions of responsibilities of each spouse. 

 

Provisions affecting child support, childcare, and health and medical expenses in prenuptial agreements are not enforceable. The courts have final say regarding these topics.
