Can I Get a Restraining Order in a Divorce?

There are two different types of restraining orders that one can get during the divorce process. A temporary restraining order and an order after a hearing.

 

Temporary Restraining Order

This is a short-term emergency order. To request one, you must already have an open case on file with the court, such as a divorce or custody case.

 

Order After a Hearing

This is a court order that limits a person’s conduct by requiring them not to harm or harass another.
