What is the Difference Between Legal Separation and Divorce?

A divorce formally dissolves a legal marriage. 

Temporary separation is an optional step before filing for a divorce. An action for a temporary separation order may be filed by either spouse if spouses are legally married, and spouses have resided in Utah for at least 90 days. 

A temporary separation order is valid for one year from the date if the hearing, or until (1) a petition for divorce is filed, or (2) the case is dismissed.

This is a reasonable option if you are unsure that you want a divorce, but you’d like the court to determine temporary arrangements involving housing, child custody and parent time, division of proeprty, etc.
